These Terms of Service ("Terms") govern your use of XPERIAUM's custom song, Heirloom Music, and Aumkara blessing reel services (the "Service"), operated by Shivanand Venkatesh Kamat, sole proprietor, trading as XPERIAUM ("we," "us," "our"), based in Bengaluru, India. By placing an order or submitting the enquiry form on our website, you ("you," "customer," "user") agree to these Terms.
XPERIAUM is currently an individually-run, early-stage service. We are not GST-registered at this time, and orders are processed manually.
We create custom, personalized songs using AI music generation tools (primarily Suno AI) combined with human direction, editing, and creative input, based on details, stories, and preferences you provide. Service tiers, pricing, song length, revision allowances, and turnaround times are as published on our website at the time of order and may be updated from time to time; the terms in effect at the time you place your order apply to that order.
Revision counts, song length caps, supported languages, and music styles for each tier are as listed on our website's pricing section at the time of order. Delivery formats by tier are: Spark — digital MP3; Melody — digital MP3 plus a text lyric sheet; Harmony — digital MP3/WAV plus a lyric sheet; Signature — digital WAV plus a designed lyric sheet; Heirloom Music — digital WAV plus album art, a designed lyric sheet, and an optional lyric video. These formats may be updated over time; the formats listed on our pricing page at the time of your order apply to that order.
Aumkara is our personalised devotional blessing reel service — a short AI-generated video in which a deity bestows a blessing upon you. This section applies to Aumkara orders and sits alongside the general terms below.
2A.1 How it works.
2A.2 Photograph requirements. Photographs must be taken at home against a plain, light-coloured wall with nothing on it — no framed pictures, shelves or calendars. Please stand about six feet from the camera, face the camera, and ensure the room is evenly lit. Do not include the floor in the frame. If your photograph does not meet these requirements we will ask for a replacement; if you are unable to provide one, we will refund you in full.
2A.3 Verification. Before we begin, we ask you to send one selfie holding a paper showing a short code unique to your order. This is how we make sure nobody can order a blessing reel using another person's photograph. If you do not send it, we will not begin production and will refund you in full. The verification selfie is deleted along with your other photographs.
2A.4 What we will not accept. We do not create reels:

2A.5 Your warranty. By placing an order you confirm that the photographs are of yourself, or that you hold the written permission of every person shown, and that no temple or pandal idol appears in them.
2A.6 AI labelling. Every reel carries a visible "AI-generated" label burned into the video, and retains its provenance metadata. This is required under India's information technology rules governing synthetically generated content. You agree not to remove, crop out, obscure or otherwise suppress this label or metadata if you share the reel. We do not supply unlabelled versions.
2A.7 Nature of the output. Aumkara reels are a devotional keepsake created with AI. The deity shown is an original artistic depiction generated by us; it is not a photograph of, and does not represent, any specific consecrated idol or temple murti. The reel is an expression of devotion, not a religious rite, ritual or consecration, and it is not a substitute for darshan, puja or any observance.
2A.8 What we cannot guarantee. AI video generation is variable. We review every reel before delivery and will not send anything we consider unsatisfactory or irreverent. However, we cannot guarantee a specific likeness, expression or motion. Your resemblance in the finished reel is an artistic interpretation and may not match your photograph exactly.
2A.9 Turnaround. We aim to deliver within 24 hours of receiving usable photographs and verification. During festival periods, volume may extend this. We will tell you if so.
2A.10 Capacity. We are a solo-operated service and accept a limited number of Aumkara orders in any period. Once capacity is reached we close orders rather than accept work we cannot deliver well.
We accept payment via UPI and, where available, through our payment gateway partner Razorpay (which supports UPI, cards, net banking and wallets). Full payment is required before work begins, unless otherwise agreed in writing (including via WhatsApp) for a specific order. We do not offer installment plans. We are not GST-registered, as our turnover is below the statutory threshold for services; no GST is charged on our prices.
Please keep your UPI transaction reference — we may ask for it to confirm payment.
For Aumkara blessing reels: you may cancel for a full refund at any time before we begin producing your reel. Once your reel has been delivered, the order is final and non-refundable. We refund in full if we cannot use your photograph, if you do not complete verification, or if we decline your order.
Approved refunds are initiated within 2 business days and typically credit back to your original payment method within 5–7 business days.

Each tier includes a specific number of lyric-stage revisions (before lock) and post-lock production revisions (after lock), as listed on our pricing page. Requests beyond your tier's included revisions may be accommodated at our discretion for an additional fee, quoted before any extra work begins.
Turnaround times listed per tier are estimates, starting from when we have all information needed from you (a complete brief/story and any requested clarifications) and payment is confirmed. Delays in your responses will proportionally extend delivery timelines. We will communicate proactively if we anticipate missing a stated turnaround window.

This section explains, as clearly and honestly as we can, what rights you get and what the current legal landscape looks like. This is general information, not legal advice; if you need certainty for a specific commercial use, please consult a qualified lawyer.
8.1 What we grant you. Upon full payment and delivery, we grant you a license to use and enjoy your song privately — for personal and family use, playing it at a private gathering, and sharing it directly with people you choose (e.g., sending the file to family members, playing it at a private event). This license does not cover posting the song publicly (including on social media, YouTube, or any other public platform) and does not cover commercial use (e.g., advertising, resale, sync licensing, or use in a monetized business context). If you want to use your song commercially, please tell us in advance so we can discuss scope, additional terms, and pricing.
8.2 Public sharing is your choice, not something we authorize. We're aware that many customers choose to post their song publicly anyway — on their own social media, YouTube, or elsewhere — since sharing a meaningful song is often part of why people commission one. We're not stopping you from doing that, and we understand why you might want to. But we want to be clear: doing so is your own choice and at your own discretion, not something covered or warranted by the license in 8.1. If you post your song publicly, you are doing so outside the scope of what we've formally granted, and any consequences of that choice are yours, not ours.
8.3 What we're actually able to grant you. Songs on our Service are generated using Suno AI on a paid subscription. Under Suno's current Terms of Service, paid-tier subscribers are assigned Suno's right, title, and interest in outputs generated during an active subscription, along with a commercial-use license for those outputs. This means we hold a license from Suno, and the license we grant you in Section 8.1 is us passing along the practical use of that song to you — it is not a claim that we, Suno, or anyone else holds an independently verified, court-tested copyright over the recording. We can only pass along what we ourselves hold; we do not — and cannot — grant you rights broader than what Suno has assigned to us.
8.4 The current legal backdrop (as of August 2026). Suno itself states it cannot guarantee that copyright will legally "vest" in AI-generated output at all, because whether AI-generated audio qualifies for copyright protection is still an unresolved legal question in most jurisdictions, including India. Separately, Suno has settled its copyright litigation with Warner Music Group (announced November 2025, involving a licensing partnership) but remains in active litigation with Universal Music Group and Sony Music as of this writing — an outcome that could still affect Suno's terms, pricing, or the standing of past output. Suno has also announced monthly download limits for its platform, taking effect from September 3, 2026, which may affect our production process but does not change the rights already assigned for songs generated before that date. We monitor these developments and will update this policy if they materially change what we can offer you.
In India, the Copyright Act, 1957 does not directly address AI-generated works. Section 2(d)(vi) attributes authorship of a "computer-generated work" to "the person who causes the work to be created," which may extend some protection where there is meaningful human creative input (our lyric-writing, direction, and editing). However, Indian courts have not yet definitively tested this provision for AI-generated music, and the Indian Copyright Office has previously shown reluctance to register works with primarily AI-driven authorship. Similarly, the U.S. Copyright Office and courts have held that purely AI-generated material without meaningful human creative control is not eligible for copyright registration.
In plain terms: no custom-AI-song provider anywhere, including us, can currently promise you an ironclad, court-tested copyright over a purely AI-generated recording — because that certainty doesn't exist yet at the source. What we can promise is the private-use license described in 8.1 (which is real and usable for the personal purposes it covers), our best-effort human creative involvement in your song's lyrics and direction, and transparency if this legal landscape changes in a way that affects you.
8.5 Your content. Any names, stories, photos, or personal details you share with us remain yours; we use them only to create your song and will not publish or reuse them without your permission (see our Privacy Policy).
You agree not to request songs or reels that are defamatory, harassing, hateful, sexually explicit involving minors, or that infringe on someone else's rights (e.g., using another artist's copyrighted lyrics or melody as your "story"). You further agree not to request content that misrepresents a real person, impersonates anyone, or could deceive others as to its authenticity. We reserve the right to decline or cancel any order that violates this, with a full refund where production has not been completed.
The Service is provided on an "as-is" basis. As a solo-operated, early-stage service, we do not carry a corporate liability structure. To the maximum extent permitted by law, our liability for any claim relating to the Service is limited to the amount you paid for the relevant order.
We may update these Terms from time to time as the service grows (e.g., adding GST registration, payment gateways, or new service tiers). The version in effect at the time of your order applies to that order. Material changes will be reflected here with an updated "Last updated" date.
These Terms are governed by the laws of India. Any disputes arising out of or relating to the Service or these Terms will be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.
